Monyo Privacy Policy

This Privacy Policy (“Policy”) forms an integral part of the Terms and Conditions of Service for users of the Monyo application. It outlines how we collect, receive, store, compile, process, use, disclose, and share personal information of individuals (“Users”) when they access or use our products and services provided via the Monyo website, application, and other available interactive channels.  

This Privacy Policy may be adjusted and amended; Users should regularly visit and review it for the latest updates. Monyo reserves the right to modify, supplement, or adjust the terms of this Policy at any time by publishing updates on Monyo’s official website and/or displaying them within the Monyo application.  

By continuing to use our products and services after the effective date of changes to this Privacy Policy, Users signify their1 acceptance of the content of the amended and updated Policy.  

In this Policy, “Monyo,” “we,” and “our” refer to Monyo Vietnam Co., Ltd.  

“User Information” refers to any information or data that can be used to identify a User, or based on which a User can be identified, and that relates to or originates from the User’s use of the Services and other information referenced in this Policy. This includes, but is not limited to, data such as name, phone number, email address, physical address, device information, application information, transaction information, access history, and customer journey.  

1. Data and Information We Collect
Monyo collects necessary data and User Information to ensure the provision and operation of its products and services comply with legal regulations. Some information is not mandatory, but failure to provide it may affect the User’s quality of experience.
1.1. Types of Information We Collect:

Information Provided by Users 

We collect any information provided by Users when interacting through our available channels or third parties to use our Services. This includes, but is not limited to, conducting transactions, participating in programs or events, contacting us, filing complaints, conducting surveys, and so on.  

Users are responsible for ensuring that the information they provide is complete, accurate, and always up-to-date to protect their rights in accordance with the relevant Service usage regulations.  

Automatically Collected Information 

Information is automatically collected when Users perform activities during their use of our Services. This includes, but is not limited to, information about the application and device used (device name, device parameters, operating system, device function status, location, IP address, browser type, referring or visiting website address from available interactive channels, number of visits, feedback, versions, and relevant information if any), transaction information performed (service, location, transaction time), and payment methods (if applicable).  

The types of data and information about applications and devices we collect, and how long we store them, will depend in part on the User’s device and settings.  

User Activity 

We collect information through User activities and information generated by Users during their interaction with our Services, such as search activities, viewing and interacting with advertisements, third parties with whom Users communicate or share content, etc.  

Collection via Cookies 

Information is also collected through Cookies on our websites, online services, and interactive applications, as well as third parties, to better understand User behavior. This includes informing us which parts of the website Users have visited, facilitating and measuring the effectiveness of advertising and web searches, thereby remembering User choices, and helping us provide a personalized experience by offering recommendations and displaying personalized content, as well as providing customized features and services. Users can manage browser Cookies by following specific instructions on web browsers.  

Information Collected from Other Sources 

In some cases, we will collect User Information from publicly accessible sources,2 which are readily available and public on websites and social networks. User Information may also be collected from third parties, including competent state agencies or commercial partners such as service providers, partners implementing lead generation programs, advertising service providers, etc.  

When we collect User Information from other sources, we ensure that such data is transferred to us appropriately and in strict compliance with3 current legal regulations.  

1.2. Children
We understand the importance of protecting children’s privacy. Specifically, our websites and applications are not designed for or directed at children under 13 years of age. We never knowingly collect or retain information about anyone under 13, except if it is part of a commitment to provide professional services. If we become aware that personal data of a child has been collected without appropriate consent, that data will be deleted as soon as possible.
2. How We Use User Information

User Information will be used by us in accordance with this Privacy Policy and for specific purposes. We only use User Information when we have a valid legal basis to do so. Depending on the case, we may rely on the User’s consent, or processing may be necessary to fulfill an agreement with the User, protect the User’s vital interests or those of others, or to comply with the law. We may also process User Information when we believe such data is in our legitimate interest or that of others, taking into account the User’s rights, interests, and expectations.  

We do not have a policy of providing User Information to any third party for their direct marketing purposes or any other purposes, unless we have complied with the legally permissible procedures under data privacy regulations to do so lawfully.  

User Information is used by us to operate, provide, and improve the Services for the following purposes:  

Providing, personalizing, maintaining, and improving our Services, including: 

  • Providing Services to Users, introducing new Services of ours or our partners based on User needs and habits during interaction and/or use of the Services.  
  • Processing User transactions and/or requests related to Service use, such as managing, operating, providing, and administering User usage and activities when using the Services; confirming transactions and making payments; processing and managing User rewards/incentives.  
  • Performing necessary activities to provide services, including troubleshooting software errors and operational issues.  
  • Conducting data analysis, testing, and research; monitoring and analyzing User usage trends and activities on our platforms; displaying personalized features for User experience; enabling interaction between Users and us or with linked partners.  
  • Conducting surveys, market research, data analysis related to service types, measuring usage, analyzing performance, and finding ways to improve and develop Services. 

Supporting request processing and User assistance: Calls, messages, and/or other forms of contact from and/or to us will be stored, including but not limited to, recordings (automatic or active), to assist in resolving legitimate User requests, monitoring and improving customer support responses, updating information systems, and enhancing service quality.  

Marketing and promotion: We may contact Users through various forms such as email, phone calls, messaging services, or online messages for the purpose of marketing and advertising our services (not excluding products and services of partners developed and provided to Users through the4 Monyo application platform).  

Complying with legal and regulatory obligations, such as fulfilling legally required reports and storing transaction data.  

Other legitimate purposes consistent with the Service’s objectives 

In certain cases related to the use of specific Services, and for User Information uses not mentioned above and/or requiring specific User consent, we will request the User’s permission for the use of User Information, and it will5 only be carried out after such permission is granted.  

3. How We Share User Information

In the event of transferring User Information to third parties or other law enforcement agencies, we ensure that such transfer complies with data privacy laws. Where necessary, we will review the privacy and information security policies of the data recipient to ensure they apply or commit to strictly adhere to standards equivalent to the principles of this Policy and relevant legal provisions.  

We do not share Users’ personal information with third parties, unless it is necessary for our legitimate business needs and those of Monyo’s partners to provide products and services to Users, or to conduct research and evaluation to understand User needs for products and services, to fulfill User requests, and/or as required or permitted by law. Specifically: 

  • Complying with requests from competent state agencies or as required by law.  
  • Providing and sharing User Information with partners as requested or confirmed by the User, through any form of electronic means on interactive channels or other forms. For example, when a User requests a service through our partner or uses a promotional program offered by a partner, the User also agrees that we may share User Information with those partners, and User Information shared with partners may be transferred to parties in connection with the Services used by the User. Our partners include partners integrated with our application or whose systems are integrated with our application, transportation service partners, financial partners, or business partners with whom we collaborate to provide promotional programs, competitive services, or other special services.  
  • We may provide User Information to vendors, consultants, marketing partners, research companies, and other service providers or business partners,6 including payment processors and support departments; server providers, information technology service providers, cloud storage providers; advertising partners and advertising platform providers; data analytics providers; research partners, including those who conduct surveys or research projects in collaboration with us or on our behalf.  
  • Exchanging, providing, and sharing User Information with third parties such as advisors, experts, agents, or our service providers and subcontractors to carry out work and services consistent with the purpose of use.  
  • Disclosing accounts and User Information when we believe it is appropriate to comply with the law, to enforce or apply our other terms and agreements,7 or to protect the rights, property,8 or safety of us, Users, or any other person.  

In other cases, Users will receive notification when User Information may be shared with third parties, and Users will have the right to refuse the sharing of information.  

4. User Access and Choices

Users are not obligated to provide any information to us; however, we will require Users to provide certain information so that they can receive information about our products, services, and events, as well as to be able to use our products and services. Users may choose not to provide certain information, but then they may not be able to use some Services.  

Users can request us to stop using or sending information for promotional purposes at any time. Please unsubscribe or adjust preferences by following specific instructions on our website and application from time to time. If Users do not wish to receive in-app notifications from us, please adjust the notification settings within your application or device.

During the use of the Services we provide, Users have the right to choose whether to provide their Contact Information to us to maximize the effectiveness of their Service experience.  

At any time, Users have the full right to stop providing access to their Contact Information by following the specific instructions on our website and application from time to time.  

By storing, securing, and ensuring data integrity, we commit not to disclose User Contact Information to any party, and in all cases, without the User’s prior consent.

Security is our top priority. Our systems are designed with the ability to ensure the safety and privacy of User information. All User Information arising from and/or related to the Services will be stored, secured, and protected by our system or our service provider in accordance with the law and this Policy.
